Traumatic Brain Injury Judgment

Jeff Tilden and Mark Wilner, along with co-counsel at Keller Rohrback, represent a family with a young boy who was struck in the head by a baseball in a batting cage resulting in traumatic brain injury. Following pretrial litigation, the parties reached a settlement, subject to court approval under SPR 98.16W, requiring the defendant to pay $2,000,000 (primary layer insurance limits) and permitting a subsequent declaratory judgment action against the insurer for an agreed, additional sum of $2,300,000 upon the establishment of coverage owed under an excess policy.
