Wins Insurance Coverage Bench Trial
April 15, 2002. Weyerhaeuser Company prevailed
on the issues remanded by the Supreme Court in the Weyerhaeuser v.
Commercial Union environmental insurance coverage litigation, King
County Cause No. 92-2-05214-8 SEA. After substantial affirmance of
the jury verdicts rendered in the environmental insurance coverage
litigation by the Supreme Court in Weyerhaeuser v. Commercial Union
Ins. Co., 142 Wn.2d 654, 15 P.3d 115 (2000), the trial court on remand
ruled Weyerhaeuser was entitled to prejudgment interest for invoices
paid at the Commencement Bay site and also awarded defense costs at
that site, interpreting Commercial Union’s obligation to pay
defense costs in addition to its per occurrence indemnity limits.
Accordingly, the court awarded $502,157.00 in prejudgment interest
and $561,158.00 in defense expenses. The bench trial on remand was
conducted by Chuck Gordon and GMT Legal Assistant Patti Godot. |
