Flat Center Farms, Inc. Prevails
In Opposing Supreme Court Review
GMT successfully represented Flat Center Farms,
Inc. in opposing a petition for certiorari to the United States Supreme
Court by the Montana Department of Revenue. The case involved a cutting-edge
area of Indian law: whether the Montana Supreme Court had correctly
held that Montana was precluded from enforcing a state licensing tax
on an Indian-owned family farm doing business in Indian country and
exclusively on Indian-owned land, when the farm was also incorporated
under the laws of the State of Montana. Jim Murray and Johanna Bender
were involved on behalf of Flat Center Farms.
