Hawaii Federal Court Rules for GMT Client in Insurance Coverage Dispute
June 19, 2003. GMT was retained as co-counsel, along with Margery
Bronster of Bronster Crabtree & Hoshibata, to represent Servco
Pacific, Inc. in environmental coverage litigation in federal court
in Honolulu, Hawaii. Today the Federal District Court in Hawaii granted
Servco's motion for summary judgment regarding the duty to defend,
which required that it address numerous issues under Hawaii law, most
of which are of first impression. The Court also denied the insurance
company's motion to dismiss a bad faith count. Jim Murray argued the
motion and Christie Snyder assisted on the briefs. The trial regarding
remaining issues is scheduled for October 2003.
