PSE Prevails in Insurance Coverage Bench Trial
June 2, 2003. Puget Sound Energy prevailed in Phase I of environmental
insurance coverage litigation against the London Market Insurers.
In Findings of Fact and Conclusions of Law entered June, 2, 2003,
King County Superior Court, Hon. Michael J. Trickey, found that PSE
had not been "made whole" by virtue of prior settlements
and that the London Market Insurers had failed to carry their burden
of proof on this issue. Trial for Phase II, relating to insurance
coverage for the sites at issue, is scheduled to commence June 9,
2003 before a jury. Jeff Tilden represented PSE in Phase I of the
trial.
