Arbitrator Rules for Policyholder on Meaning of "Absolute" Pollution Exclusion
October 27, 2003. GMT represented the Bainbridge Island School District in an insurance coverage dispute with the Washington Schools Risk Management Pool. The parties disagreed regarding the applicability of the so-called "absolute" pollution exclusion to a claim brought against the District for injuries allegedly suffered by a former student as a result of exposure to solvent vapors. Today, the arbitrator issued a ruling in favor of the District, finding the exclusion inapplicable to a bodily injury claim "rooted in [alleged] negligence."
