GMT Obtains Summary Judgment for Puget Sound Energy
April 1, 2004. Today GMT obtained summary judgment for Puget Sound Energy (“PSE”) in a catastrophic personal injury case. The plaintiff, age 13, and his friend, age 14, intentionally lassoed a PSE 115,000 volt transmission line with a strand of Christmas lights. The Skagit County Superior Court granted PSE summary judgment holding that PSE had no duty to elevate its transmission lines higher than required by Washington law, or give any warnings, because no reasonable jury could conclude that the plaintiff’s actions were foreseeable to PSE. PSE was represented by Jeff Thomas and Dan Houser.
