GMT Client Prevails in Insurance Broker-Liability Action
May 27, 2004. GMT partner Frank Cordell, along with co-counsel
Roger Anderson, represented the owners of the BluWater Bistro, a successful
Seattle restaurant group, in a lawsuit against their former insurance
broker. The suit alleged that the broker acted negligently in procuring
the policyholder’s general-liability policies, with the result
that the policyholder lacked coverage for a subsequent third-party
liability claim. In April 2003, Judge Michael J. Fox of the King County
Superior Court entered judgment in favor of BluWater. The broker appealed,
and on March 1, 2004, Division I of the Court of Appeals affirmed
that judgment. The parties settled the case in June 2004.
