GMT Client Prevails on Broad Range of Environmental Coverage Issues

Cadet Manufacturing Company, based in Vancouver, Washington, is one of the nation's leading manufacturers of home heating equipment. GMT represents Cadet in an environmental insurance coverage litigation in U.S. District Court for the Western District of Washington, in Tacoma.

On October 5, 2005, Judge Burgess ruled for Cadet on four motions for partial summary judgment brought in connection with Cadet's claims againt Granite State Insurance Company. Judge Burgess's detailed opinion resolves in the policyholder's favor a broad range of coverage issues, including the (non-) existence of aggregate limits on the policies, the number of occurrences for purposes of application of limits, the so-called "stub" policy issue, and the scope of an umbrella insurer's duty to defend.
