The Catholic Diocese of Spokane recently prevailed on a summary judgment motion brought by the Washington Insurance Guarantee Association in an insurance coverage action pending in federal court in Spokane, Washington. The court, among other things, ruled that "WIGA" is obligated to stand in the shoes of an insolvent insurance company for the purpose of the imposition of liability for attorneys fees against an insurance company in a coverage action under Washington common law. The court also denied WIGA's summary judgment motion against the Diocese on grounds of failure to exhaust other policies and based on certain offset theories.
