GMT filed an environmental insurance coverage lawsuit on behalf of Boeing against Pacific Indemnity Company in Los Angeles County Superior Court in 2005.  The lawsuit relates to various historical liabilities of North American Aviation, Inc. and North American Rockwell Corporation.  Boeing is the merger-successor to those named insureds.  The parties filed cross-summary judgment motions on the issue of whether Boeing had standing to assert claims under the policies as a merger-successor to the named insureds under the California Supreme Court’s decision in Henkel v. Hartford.

On July 14, 2006 the trial court (Hon. Jane Johnson) held a hearing and granted Boeing’s motion for summary adjudication and denied Pacific’s cross motion.
