GMT represented PeaceHealth, Inc. in litigation against an ophthalmologist and PeaceHealth relating to a patient’s death following cataract surgery. The death resulted from bradycardia, a known, but rare and unforeseeable complication of retrobulbar block anesthesia. The defendants proffered testimony indicating that the complication can occur under conventional conditions of care and the fact that it did occur does not imply negligence under the res ipsa loquitur doctrine. The Court ruled that the doctrine was inapplicable to the case at bar and the case was subsequently voluntarily dismissed with prejudice by the plaintiff.
