GTTC Obtains Dismissal of Sex Abuse Suit

GTTC Partner Michael Rosenberger obtained summary judgment in the Eastern District of Washington for long-time GTTC client, The Church of Jesus Christ of Latter-day Saints. During the 1970s, the plaintiff participated in a program sponsored by the LDS Church that placed Native American children living on reservations with LDS families to enhance educational opportunities for those children. Plaintiff alleged she was sexually abused by relatives of her foster family. On behalf of the church, Mike argued that even under Washington’s liberal statute of limitations in abuse cases, the claim was time-barred because plaintiff was diagnosed with post-traumatic stress disorder 18 years ago and she admitted she understood at the time that her condition was caused by the abuse. In a July 2018 order, the court agreed and dismissed plaintiff’s claims.
