GTTC Prevails on Big Bertha Venue Dispute in Division One

GTTC attorneys Dale Kingman, Matt Pierce, and Greg Pendleton represent Seattle Tunnel Partners (STP), the contractor building the SR 99 Alaskan Way Viaduct Replacement Project. STP has sued its insurers seeking coverage for physical damage suffered by STP’s tunnel boring machine. STP’s co-plaintiff, WSDOT, sought to transfer the insurance case to Thurston County. STP opposed and prevailed on motions practice in King County Superior Court. WSDOT appealed to the Washington Court of Appeals, Division One. STP submitted further briefing and Greg Pendleton argued the appeal. The commissioner agreed with STP’s arguments and denied WSDOT’s Motion for Discretionary Review. The litigation will proceed locally in King County, the community the project serves.
